1. Subject of the Agreement
1.1. At the Customer’s request, the Contractor provides services to assist in selecting an Offer, placing an Order with Third-Party Suppliers, arranging receipt of the data for a travel electronic SIM profile (eSIM) and delivering that data to the Customer. The Customer pays for the Services under the terms of the selected Order.
1.2. The Customer selects the specific Offer (country or region, data allowance, validity period, restrictions, price, conditions for starting use and compatibility) on the Website before payment. These terms form part of the Agreement.
1.3. The Contractor interacts with the technical systems of Third-Party Suppliers, including through APIs. The result of the Services is the performance of the actions required by this Agreement and delivery to the Customer of a valid Activation Key enabling installation of the eSIM on a compatible device in accordance with the selected Offer.
1.4. The Contractor is not a Mobile Network Operator and does not itself provide mobile communications services. Third-Party Mobile Network Operators provide data transmission. This does not release the Contractor from responsibility for properly providing its own Services and accurate information.
2. Ordering and Payment
2.1. The Customer selects an Offer, checks device compatibility, provides a valid email address and any other required information, and then confirms the Order.
2.2. Before payment, the Website displays the total price, key eSIM characteristics and material restrictions. The Order price includes the Contractor’s fee and the costs necessary to arrange provision of the eSIM, unless a different price structure is expressly stated during checkout.
2.3. Payment is made by the methods available on the Website through a payment service. Payment for the Order constitutes acceptance of this offer. Before paying, the Customer may review the offer and confirm having done so by ticking a checkbox.
2.4. The Contractor begins performance after payment is confirmed and issues a fiscal receipt in the cases and manner required by Russian law.
2.5. If funds are debited without an Order confirmation, the Customer contacts support with the payment details. The Contractor checks the transaction and, if payment is confirmed, fulfills the Order or resolves the refund in accordance with the law.
3. Provision of Services and Receipt of the eSIM
3.1. The Contractor arranges receipt and delivery of the eSIM data, normally within 10 minutes after payment confirmation and no later than 12 hours, unless a different period was stated before payment for the specific Offer.
3.2. The Activation Key is delivered to the Customer by email and/or through the account on the Website. Technical logs may confirm that it was sent, but do not rule out an assessment of the merits of a complaint.
3.3. The Customer installs the eSIM independently following the instructions. Installation requires a compatible device, internet access and the absence of technical or regional restrictions. Material aspects of installation, activation, reinstallation and use are disclosed before payment in the Offer details and the instructions on the Website.
3.4. The Data Package’s validity period may begin when the eSIM is installed, when it first connects to a network, or upon another event disclosed before payment. Coverage and speed depend on the Mobile Network Operators’ networks. Unlimited Offers may be subject to fair usage restrictions (FUP), which are disclosed before payment.
3.5. The Services are deemed provided once the Contractor has performed the actions required by this Agreement and delivered to the Customer a valid Activation Key matching the selected Offer. This does not limit the Customer’s rights if the Services are defective.
3.6. If the Offer provides for a Top-Up, the Customer may place a separate paid Order. A Top-Up results in an additional amount of mobile data and/or an additional period of use for the eSIM previously obtained. The terms and timing of the Top-Up are disclosed before payment.
3.7. If performance is impossible, the Contractor informs the Customer and offers performance within an agreed period, an alternative with the Customer’s consent, or a refund in cases provided by law.
4. Withdrawal, Defects and Refunds
4.1. The Customer may withdraw from the services agreement at any time under Article 32 of the Law of the Russian Federation “On Protection of Consumer Rights”, subject to paying the expenses the Contractor actually incurred in performing obligations under the specific Order. The Contractor must substantiate the existence and amount of those expenses.
4.2. If the Contractor has neither incurred expenses nor provided Services before withdrawal, the amount paid is refunded in full. The mere issuance or activation of an Activation Key does not automatically preclude a lawful claim.
4.3. When considering a withdrawal, the Contractor takes into account the actions actually performed, payment to the supplier, whether the profile can be cancelled, and whether the supplier can refund the payment. The fact that a payment to the supplier is non-refundable does not in itself establish the amount of expenses that may be deducted from the Customer’s refund.
4.4. If the Activation Key is invalid, installation is impossible for reasons attributable to the Contractor, or the result does not match the stated characteristics, the Customer may assert the claims provided by law. The Contractor may conduct a technical investigation without extending statutory deadlines.
4.5. A refund request is sent to the support email address with the Order number and a description of the circumstances. Statutory claims are satisfied within the periods established by law; voluntary requests are considered within 10 calendar days. Refunds are made to the original payment method or by another lawful method agreed by the parties.
5. Rights and Obligations of the Parties
5.1. The Contractor undertakes to provide the Customer with accurate information about the selected Offer, arrange the Order and deliver a valid Activation Key in accordance with this Agreement, as well as to consider the Customer’s requests and satisfy lawful claims.
5.2. The Contractor may engage suppliers and technical contractors while remaining responsible within the scope of its obligations and applicable law, and may request information necessary to identify an Order and resolve a problem.
5.3. The Customer must provide accurate contact details, check device compatibility, and follow the instructions and restrictions of the selected Offer.
5.4. The Customer may receive information about performance, contact support and assert claims in cases provided by law.
6. Liability
6.1. The parties are liable for breaches of their obligations under the laws of the Russian Federation.
6.2. The Contractor is responsible for arranging the Order, the validity of the data delivered and the result’s conformity with the stated characteristics.
6.3. The Contractor does not guarantee network coverage at every point within the stated area, constant speed or uninterrupted service, unless expressly promised in the Offer characteristics. This does not exclude liability for inaccurate information or defects in the result.
6.4. Inability to use a functioning eSIM solely because of device incompatibility or failure to follow the instructions is assessed in light of whether the necessary and accurate information was provided before payment.
7. Claims and Disputes
7.1. Claims are sent to the Contractor’s email address with information identifying the Order. The Contractor responds within 15 calendar days, unless the law requires a shorter period for satisfying a specific claim.
7.2. Pre-trial settlement is voluntary unless the law requires it. Disputes are heard by courts with due regard to the consumer’s right to choose the court with jurisdiction.
8. Final Provisions and Contractor Details
8.1. This offer is effective from the date of publication until withdrawn or replaced. A new version applies to new Orders and does not change previously concluded agreements without a lawful basis or the parties’ agreement. The Contractor retains the ability to identify the version in effect when an Order was placed.
8.2. Electronic messages may be sent to the addresses provided by the parties and used as evidence in accordance with Russian law.
8.3. Personal data is processed in accordance with Russian law and the Personal Data Processing Policy: https://esimtotrip.com/legal/privacy.
8.4. Relations between the parties are governed by Russian law, including mandatory consumer protection provisions.
